    QUESTION OF SANITY.
    Yesterday at the North Melbourne Court, before Messrs. G. V. Blackburne (chairman), J. Barwise, W. H. Fuller, and A. E. Hughes, J.P.'s, Michael francis Daly was charged with having com- mitted a criminal assault on Mrs. Annie Barbour, and also with having broken windows, the pro- perty of Edwin Barbour and George Adams, on July 29. Inspector Hore prosecuted, Mr. T. Nolan appeared for Daly, and Mr. Cume watched the proceedings on behalf of Mrs. Barbour.
    Mr. Nolan asked that Daly be remanded for a week for medical inquiry. He put in documents by Drs. O'Brien and Rennie to the effect that Daly was affected mentally, although the former said he would have liked to have an opportunity of fur- ther examining Daly. Mr. Nolan said Dr. O'Don- nell, of North Melbourne, and Dr. Bird, also thought Daly was not in his full senses. If he were remanded for inquiry, and found to be insane, the Chief Secretary could make an order for his removal to an asylum.
    Inspector Hore said the master in lunacy had claimed Daly, but it was a grave question whether Daly should be returned to any place as an ordi- nary lunatic. The surroundings of the case seemed to indicate criminal lunacy, and he would ask the Bench to grant an ordinary remand for seven days, and then to hear the evidence, and if they were satisfied a prima facie case had been made out let them commit for trial, and if Daly was adjudged insane in the higher court he could then be ordered to be detained during His Excel- lency's pleasure by a judge of the Supreme Court.
    Mr. Nolan.-What is all the difficulty about? There seems to be some petty difference between the Lunacy department and the chief commissioner of police.
    Inspector Hore.-That is not so, and I will not allow it to go forth that it is so. I want a re- mand for seven days, but not for medical inquiry. Even Supposing such a remand as the latter were granted, and accused was found to be insane, it would not necessarily follow that he was insane when he committed the offence. There is no ques- tion of lunacy before this Court at all.
